Authorization To Place AD
THIS IS NOT AN "AUTHORIZATION TO SELL" NOR TO "LIST" PROPERTY FOR SALE.
IT IS AN OPPORTUNITY TO ADVERTISE YOUR PROPERTY OR YOUR "LISTINGS" OF PROPERTY THAT IS FOR SALE OR EXCHANGE ON OUR WEBSITE FOR EXPOSURE TO THE GENERAL INTERNET POPULATION AT NO COST TO YOU.
For clarification, we will use the following terminology to describe the parties:
James A. Smith is a Real Estate Broker. As the advertising source and potential Buyer’s Broker, shall hereinafter be referred to as "SMITH."
"REAL ESTATE INVESTMENTS & 1031 EXCHANGES" is the name of the Website on which all ads will be placed originally, and shall hereinafter be referred to as "THE SITE."
Property Owner is the party or parties that are recorded owners of the property being advertised for sale or exchange and shall hereinafter be referred to as "OWNERS."
Brokers who wish to place their actively "Listed" property (ies) on the "Real Estate Investments &1031 Exchanges" Website shall hereinafter be referred to as "AGENTS."
The potential Buyer or Taker (in an exchange) of a property shall hereinafter be referred to as the "CLIENT" and will be Smith’s "CLIENT."
By typing their eMail address below, OWNER and/or AGENT, hereby authorizes "SMITH" to place their property or listing, for exposure on the Internet, on "THE SITE" as for Sale or Exchange or either, subject to all of the terms and conditions listed below.

PLEASE READ CAREFULLY
No property may be placed on "THE SITE" unless the Owner or Agent complies with all the United States Federal Fair Housing requirements as ammended 1968, please read the link.
All communications with Owners or Agents will
be via eMail, regular mail and telephone.
Thus an eMail account is required.
SMITH works as a "Buyer’s Broker" and our Brokerage fees shall be paid by the CLIENT. We do not work as a "Sub-Agency" and will abide by the rules of Buyer’s Broker only.
When, and only when, a potential CLIENT is located, OWNERS placing the ad will be required to execute an "Authorization to Sell or Exchange" agreement for that particular CLIENT and for that particular property. This agreement will indicate the price, term of agreement and terms of a potential sale or exchange.
SMITH reserves the right to accept or deny any request to place an ad on THE SITE for a property for sale or exchange or either, for any reason deemed necessary by SMITH. SMITH shall also reserve the right to choose the information for and format of the ad from the content of the information provided to SMITH by Owner or Agents.
Owners or Agents acknowledge that all inquiries will come to SMITH and communication shall be solely between Owner or Agent placing property on THE SITE for exposure and James A. Smith, Associate Broker with Linda Wolen, and Associates, Real Estate, Inc. Those who inquire about property placed on THE SITE shall be deemed the CLIENT of SMITH and SMITH intends to be the CLIENT’S Broker.
To place your ad please supply us with as much of the following as possible:
1. Complete the Owner/Agent Property Data Form
2. A 4 in. X 6 in. glossy color photo(s) of your property,
maximum of 3 (not mandatory);
3. Signed income and expense form or APOD (Annual Property
Operating Disclosure);
4. Appraisal of property if available;
5. Seller’s Property Disclosure Statement, if available;
6. (Agents) Verification of Authorization to sell from Owner;
7. Any other information you deem important to a sale or
exchange.

All information, pictures and documents sent to and received by SMITH regarding any property to be placed on THE SITE shall become the property of SMITH, exclusively unless otherwise agreed to by all parties in writing prior to receiving such items.
Owner or Agent shall hold SMITH, THE SITE, THE SITE PUBLISHER, TITLE COMPANIES INVOLVED, ATTORNEYS, ACCOUNTANTS, and any and all persons using the information submitted to SMITH, harmless from all causes due to any inaccuracies or misstatement of facts in any of the information given to SMITH by Owner or Agent submitting such information.
All properties placed on the THE SITE are subject to prior sale, exchange or withdrawal from THE SITE by either SMITH or Owner or Agent. All information contained in any placement is deemed to be accurate and is in no way guaranteed by SMITH, expressed nor implied. Any ad placed on THE SITE may be removed by either party by eMailing a notice to withdraw ad at any time.
